Our website located at ("Site" or "Website") and our associated BLACK BEAUTY software application ("Application") (the Website and Application collectively referred to as "Digital Services") are owned and operated by Harsco Minerals.  The purpose of our privacy policy is to inform you about the types of personally identifiable information we gather about you when you access or use our Digital Services, how we may use such information, whether we disclose it to anyone, and the choices you have regarding our use of, and your ability to review and correct the information.  The phrases "personally identifiable information" or "personal information" mean any information by which you can be identified, such as your name, address, telephone number, picture, etc.  This Privacy Policy applies only to users accessing our Digital Services from the United States.  Please read our complete Privacy Policy.  By using any of our Digital Services, you agree with the terms of this Privacy Policy, which is part of, and governed by Harsco Mineral's BLACK BEAUTY App Usage Agreement.  Whenever you submit information via the Digital Services, you consent to the collection, use and disclosure of that information in accordance with this Privacy Policy.  If you do not agree to the terms of our Privacy Policy or the App Usage Agreement, please do not use our Digital Services.

Unless we have your express consent, we will not sell, rent, share, trade or otherwise disclose any personally identifiable information to any third party, except for those with whom we contract for data storage/hosting services, which would naturally have access to such information through their use of the normal functionality of our Digital Services.

We may provide certain aggregate information we collect from users of the Digital Services (e.g., statistics, sales, traffic patterns and services) to third parties who can assist us in analyzing and understanding the information and help us to better provide online products and services.  Should we share this aggregate information with third parties, it will not include any personally identifiable information. 

We may transfer your personal information to a third party in the context of a business transaction such as a sale of our assets.

From time to time, we may be required to provide personal information in response to a valid court order, subpoena, government investigation, or as otherwise required by law. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful. We may release certain personal information when we believe that such release is reasonably necessary to protect the rights, property, and safety of others and ourselves.


We will take reasonable steps to protect your personal information that you transmit to us and the Digital Services and to protect such information from loss, misuse and unauthorized access, disclosure, alternation or destruction. Please be careful whenever sending personal information to Harsco Minerals via the Internet, as no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee or warrant the security of any information you transmit to or from our Digital Services, or that this information will not be lost or used in a fraudulent manner and we encourage the use of encryption to communicate with us. We, and any third party we engage, will maintain physical, electronic and procedural safeguards to ensure that personal information is stored and treated responsibly.


Harsco Minerals takes children's privacy seriously and wants children and parents to understand that our Digital Services are not intended for children under the age of 13.  If you are under the age of 13, please do not use the Digital Services.  We do not seek to collect personal information about children through our Digital Services.  If we become aware that a person submitting personal information to us through any part of our Digital Services is a child under the age of 13, we delete the information as soon as we discover it and do not use it for any purpose, nor do we disclose it to third parties.  Since we do not seek to collect any personal information about children, and we delete information collected inadvertently as soon as we discover that a child has submitted it, we typically retain no information about children that could be reviewed or deleted.  If a parent requests review or deletion of information about their child before we have discovered and deleted the information, we will of course honor that request.


If there is any material change in our Privacy Policy, the revised statement will be posted on the Website and Application. Please check this page periodically for changes.  When changes are made we will update the effective date of this Policy.

Before we are able to provide you with any information, correct any inaccuracies or delete any information, however, we may ask you to verify your identity and to provide other details (in a secure manner) to help us to respond to your request.
